Kenneth Holliday of Scott Depot wanted to open a "Secret Pleasures" location along MacCorkle Avenue earlier this month but was barred from doing so after the planning commission secured a temporary injunction in Kanawha Circuit Court.
The county said Holliday's store violated a ordinance that prohibits an "adults only" business from locating within 2, feet of a church or school. Holliday's proposed location would have placed it within that distance of McKinley Middle and Weimer Elementary schools and Landmark and Pilgrim Baptist churches.
I don't even carry adult magazines. The majority of my business is lingerie, posters, black light stuff, massage oils, just stuff that you can sell to anybody. Commission attorney Mark Slotnick confirmed he was planning to meet with Holliday sometime in the next two weeks to discuss the store's inventory and determine if the adult content falls under the "substantial or ificant" criteria set forth by the ordinance. Holliday was out of town on vacation and unavailable for comment Tuesday, but Slotnick said he had been "very agreeable" to work with throughout the process.
The hearing on the county's request for a permanent injunction has been slated for 3 p. Slotnick said the temporary injunction prohibiting the store from opening remains in effect until that hearing. Contact writer Jared Hunt at jared.
